“A public comment period is conducted prior to each regular session of the city council from 6:30 p.m. to 7:00 p.m.  Any person wishing to address the council shall make such request to the city clerk by noon on Wednesday prior to the regular session and shall submit their name and the topic of said comments.  Each person shall be allowed a maximum of five minutes to speak during the comment period.  No public comments concerning any zoning amendment to be considered by the city council at such regular session shall be received during this period.”  (City Code Sec. 1-204(c)) CLARKSVILLE CITY COUNCIL REGULAR SESSION

PUBLIC COMMENTS

Christie Rodriguez asked that ordinances pertaining to dangerous dogs be enforced and that the public be made aware if a dangerous dog is kept in a residential area.

Robert Ott, Billy Hadley, Japhet Nussbaumer, and Bailey Allen expressed strong opposition to the proposed East/West Corridor.

SPECIAL RECOGNITIONS

Mayor Piper presented a Certificate of Appreciation to Clarksville Firefighters Ben Workman and Gary Santora for saving the life of a young girl on who had stopped breathing because of a popcorn kernel lodged in her throat.

PULBIC HEARING

Councilman Grubbs made a motion to conduct a public hearing for comments regarding zone changes. The motion was seconded by Mayor Pro Tem Redd. A voice vote was taken; the motion passed without objection.

ORDINANCE 95-2009-10 Amending the Zoning Ordinance and Map of the City of Clarksville, application of Frances D. Spencer, Syd Hedrick-Agent, for zone change on property at Centerstone Circle & Needmore Road from AG Agricultural District to R-4 Multiple Family Residential District

Syd Hedrick said the owner intended to sell the property and felt R-4 would be the most appropriate zoning for future development. There was no expressed opposition.

ORDINANCE 96-2009-10 Amending the Zoning Ordinance and Map of the City of Clarksville, application of James R. Proctor, Steven Settlers, Byers & Harvey-Agent, for zone change on property at Golf Club Lane & Crossland Avenue from R-2 Single Family Residential District to R-4 Multiple Family Residential District

Steve Settlers said potential developers expressed interest in the property only if it were zoned R-4. Renea Abbott said the existing sewer system was inadequate and drainage problems already exist. Henry Livingstone asked that the natural state of the property be preserved.

Councilman Grubbs made a motion to revert to regular session. The motion was seconded by Mayor Pro Tem Redd. A voice vote was taken; the motion passed without objection.

ZONING

The recommendations of the Regional Planning Staff and Commission were for approval of ORDINANCE 95-2009-10. Councilman Grubbs made a motion to adopt this ordinance on first reading. The motion was seconded by Mayor Pro Tem Redd. The following vote was recorded:

AYE: Allen, Burkhart, Grubbs, Harris, C. Johnson, Redd, Summers, Wallace

NAY: McLaughlin

The motion to adopt this ordinance on first reading passed.

The recommendations of the Regional Planning Staff and Commission were for approval of ORDINANCE 96-2009-10. Councilman Grubbs made a motion to adopt this ordinance on first reading. The motion was seconded by Mayor Pro Tem Redd. The following vote was recorded:

AYE: Burkhart, Grubbs, Redd, Wallace

NAY: Harris, C. Johnson, McLaughlin, Summers

The motion to adopt this ordinance on first reading failed due to lack of majority.






CONSENT AGENDA

All items in this portion of the agenda are considered to be routine and non-controversial by the Council and may be approved by one motion; however, a member of the Council may request that an item be removed for separate consideration under the appropriate committee report:

1. ORDINANCE 74-2009-10 (Third Reading) Amending the Official Code relative to sewer rates

2. ORDINANCE 90-2009-10 (Second Reading) Establishing Solid Waste Flow Control

3. Approval of Minutes: May 6th and May 12th

Councilwoman McLaughlin made a motion to adopt the Consent Agenda as presented. The motion was seconded by Councilman Grubbs. A voice vote was taken; Councilman Harris voted “nay” on ORDINANCE 90-2009-10. The motion to adopt the Consent Agenda passed.

BUILDING & CODES COMMITTEE
Wallace Redd, Chair

Mayor Pro Tem Redd said the Building & Codes Department processed 422 complaints during the month of May and reported 341 properties had been affected by the May 1st flood.

COMMUNITY DEVELOPMENT COMMITTEE

RESOLUTION 57-2009-10 Adopting the Multi-Jurisdictional Hazard Mitigation Plan

Councilwoman McLaughlin made a motion to adopt this resolution. The motion was seconded by Councilman Summers. The following vote was recorded:

AYE: Allen, Burkhart, Grubbs, Harris, C. Johnson, McLaughlin, Redd, Summers, Wallace

The motion to adopt this resolution unanimously passed.

ORDINANCE 91-2009-10 (First Reading) Authorizing extension of utilities for property on Sango Road; request of DBS & Associates

Councilman Summers made a motion to adopt this ordinance on first reading. The motion was seconded by Councilwoman McLaughlin. The following vote was recorded:

The motion to adopt this ordinance on first reading unanimously passed.

Mayor Pro Tem Redd changed his vote to “aye.” The motion to adopt this ordinance on first reading unanimously passed.

PARKS & RECREATION COMMITTEE

Councilwoman McLaughlin announced Clarksville Parks & Recreation recently won the Governor’s Environmental Stewardship Award for the Clarksville Greenway. The department was awarded a recreational trail grant in the amount of $43,000.

PUBLIC SAFETY COMMITTEE
Joel Wallace

Councilman Wallace reported 614 calls were answered by Clarksville Fire & Rescue during the month of May and 798 arrests were made by the Clarksville Police Department during the month of April.

Councilman Grubbs thanked both departments for excellent response to emergency situations caused by the May 1st flood.

STREET COMMITTEE

Councilman Summers commended the Street Department for their professional actions following the May 1st flood.

TRANSPORTATION COMMITTEE

NEW BUSINESS

ORDINANCE 93-2009-10 (First Reading) Amending the Official Code relative to reservation of land for parks, roadways, or other public sites or uses

ORDINANCE 94-2009-10 (First Reading) Establishing a moratorium on development along the proposed East/West Corridor

Councilman Summers made a motion to adopt both ordinances on first reading. The motion was seconded by Councilwoman McLaughlin. Councilman Summers then made a motion to postpone action on both ordinances to the next meeting. The motion was seconded by Councilwoman McLaughlin. Councilman Summers suggested an information meeting be held for property owners who may be affected by construction of the proposed East/West Corridor. Councilman Harris objected to the entire project. Councilman Burkhart said all utility providers must be included in the planning for this project. Councilwoman Candy Johnson opposed postponing this vote. The following vote was recorded:

AYE: Allen, Grubbs, McLaughlin, Redd, Summers, Wallace

NAY: Burkhart, Harris, C. Johnson

The motion to postpone action on both ordinances passed.

MAYOR AND STAFF REPORTS

Gas-Water-Sewer General Manager Pat Hickey said although the City’s Wastewater Plant’s current processing was limited following the May 1st flood, it would not be fully operational for approximately eighteen months .
